Road Rage Leads to Assault and DUI
A strange incident apparently stemming from a dispute in a night club in RI leads to criminal charges of OUI and assault with a deadly weapon in Massachusetts, after a road rage induced crash on I-495.
According to the Attleboro Sun-Chronicle, the defendant ran into the victims car six times on I-495 in Mansfield.
Deliberately hitting someone with your car is considered assault with a dangerous weapon, a felony under Massachusetts laws. She was also charged with counts of driving to endanger, and OUI. The judge in Attleboro District Court sentenced her to 2 1/2 years of probation in total, finding her guilty of the assault and driving to endanger charges, and agreeing to a Continuation without a Finding (CWOF) on the drunk driving (OUI) charge.
It is an unusual story on several levels, especially considering that if the incident began with an argument in a nightclub in Providence, RI, and ended on 1-495 in Mansfield, that means the defendant chased or followed the victim for approximately 20 miles.
That indicates a pretty serious grudge, and a well-sustained road rage. The defendant is probably very lucky not to have been locked up, if those are the facts. Chasing someone for 20 miles, and trying to run them off the road is no small thing.
The article in the Sun Chronicle also quotes the prosecuting attorney, who said that the victim suffered nightmares from the incident, which is not hard to imagine. There is likely some civil liability there as well.
As you can see, road rage can be more than just property damage. It can lead to all kinds of difficult situations, with criminal implications.
